New legislation now in force

The Regulation and Inspection of Social Care (Wales) Act 2016 came into force on 2 April 2018.

Under the new Act, how we register and inspect adult services will change. 

There will be a greater focus on securing improvement in the quality of care and support, and on well-being outcomes for people using services.

We have increased powers to ensure we can take swifter, stronger action when we need to.

Which services does this affect?

These changes will impact on the following services:

  • Care homes
  • Children’s homes
  • Domiciliary care
  • Residential family centres, and
  • Secure accommodation services.

Changes for providers

New code of practice for inspection

We have a new code of practice for inspection which details our approach to inspecting.

New online notifications service

Once an application to re-register has been fully accepted and approved by us, care home providers will be able to make notifications to us online.

Registered managers

The new law means that managers will be removed from Care Inspectorate Wales’ registration from April 2018. We will be writing to all managers shortly.

Registered providers must still appoint a manager and the manager must be appropriately qualified and registered with Social Care Wales. (External link)

Re-registering under the new Act

The following care services are required to apply to re-register their service with us this year:

  • Care homes
  • Children’s homes
  • Domiciliary care
  • Residential family centres, and
  • Secure accommodation services.

These services should have received correspondence from us earlier this year about re-registering.
