This is the fourth annual report on the operations of the Deprivation of Liberty Safeguards in Wales. It is a joint report between Care and Social Services Inspectorate Wales (CSSIW) and Healthcare Inspectorate Wales (HIW).
What are the Safeguards?
The Safeguards exist to empower and protect any individual with mental disorder, where is doubt about their mental capacity, to make informed decisions about their care when they are hospital patients, or residents in a care home.
- More needs to be done to understand the relevance of the Safeguards and implement them consistently in practice
- There is significant variation in how local health boards and local authorities carry out their duties as supervisory bodies
- Requests for reviews of the qualifying arrangements in social care and health are infrequent
- Fewer people received support from Independent Mental Capacity Advocates in 2012-13 than in the previous year
